Cilla Carden, a resident of Girrawheen, insisted that her neighbors quit smoking, grilling, and playing ball in their own garden, even going so far as to take them to court.
She insisted that the scent of grilling meat next door was driving her crazy.
“They placed it there intentionally so that all I can smell is fish. I’m unable to go outside and enjoy my backyard,” she remarked.
The children’s basketball games and the cigarette smoke that drifted into her yard infuriated the massage therapist as well.
“It’s been devastating, it’s been turmoil, it’s been unrest, I haven’t been able to sleep,” she stated.
In order to demonstrate that he had taken down the barbecue and stopped the kids from playing basketball, one neighbor allowed 9News inside the backyard.
Carden brought the matter before the Supreme Court as well as the State Administrative Tribunal.
She stated: “It’s deliberate, that’s what I told the courts, its deliberate.”
Her lawsuit was dismissed by the State Administrative Tribunal and the Supreme Court Judge, and her plea to appeal was turned down.
She insisted that she would not give up and would soon appear in court again.
